Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ThymlyChef mobile application and website (the "Service"), operated by KeelyApps LLC ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@thymlychef.com if you suspect unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

3. Subscription and billing

Free tier

ThymlyChef offers a free tier with limited features (currently 10 recipes per month). No payment information is required for the free tier.

Paid subscriptions

ThymlyChef Plus ($6.99/month) and ThymlyChef Pro ($9.99/month) are billed through Apple App Store or Google Play Store in-app purchases. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription at any time through your device's App Store or Play Store account settings. We do not process refunds directly — all refund requests must be submitted through Apple or Google.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload content that is harmful, offensive, or infringes on the rights of others
• Attempt to gain unauthorized access to any part of the Service or its infrastructure

5. Recipe and content accuracy

ThymlyChef generates recipes, nutrition estimates, and meal plans using automated technology. While we strive for accuracy, we do not guarantee that any recipe, nutritional information, or dietary guidance is complete, accurate, or suitable for your individual health needs. The Service is not a substitute for professional dietary or medical advice. If you have specific health conditions, allergies, or dietary requirements, please consult a qualified professional before relying on content generated by the Service.

6. Intellectual property

The ThymlyChef name, logo, sprig mark, and "Your Kitchen, Your Chef" tagline are trademarks of KeelyApps LLC. The Service and all content, features, and functionality are owned by KeelyApps LLC and protected by applicable intellectual property laws.

You retain ownership of any content you upload to the Service (such as pantry data and recipe card photos). By uploading content, you grant us a limited, non-exclusive license to use that content solely to provide the Service to you.

7. Third-party services

The Service integrates with or links to third-party services including Anthropic (AI processing), Supabase (data storage), Apple HealthKit, and grocery apps (Instacart, Walmart, Kroger, Amazon Fresh). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KEELYAPPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may terminate your account at any time by following the steps on our Delete Account page. Upon termination, your right to use the Service ceases immediately.

11. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in Missouri.

12. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the effective date above. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
